Airtime Terms of Service
1. Introduction
Transfer Galaxy AB (”Transfer Galaxy”, ”us”, “our” or “we”), reg.no. 556978-4464, with registered office at Osmundgatan 12, 703 83 Örebro, is a payment institution incorporated in Sweden and licensed by the Swedish Financial Supervisory Authority (“Finansinspektionen”). The company has developed several digital services provided through the applications ”Transfer Galaxy Money Transfer” and ”Transfer Galaxy Airtime” (the ”Applications”).
The terms and conditions stated herein apply to your use of our platform for purchases of prepaid airtime value (the “Airtime Service”). Other services provided by Transfer Galaxy, such as our money remittance service, are governed by separate terms and conditions.
We emphasise that the Airtime Service may be made available through several of our Applications and that these Terms of Service will apply to the Airtime Service as such, regardless of which Application you use to access the service.
The Airtime Service is not part of our regulated payment service operations and not subject to supervision from Finansinspektionen.
2. Terms of Service
The terms of service for the Airtime Service are comprised of the terms and conditions set forth below in this document and any additional terms and conditions, disclosures, notices, policies and documents, as referred to herein, and/or provided on our website (together the “Terms of Service”).
You (or the “User”) agree to be bound by the Terms of Service by registering as customer with Transfer Galaxy or otherwise by using the Airtime Service.
By accepting these Terms of Service, you confirm that neither you nor the recipient are subject to any sanctions imposed by the EU, the UN, the UK and/or the US and that the Airtime Service will not be used for illegal purposes, such as e.g. money laundering, terrorist financing or fraud. Nor will the Airtime Service be used to dispose of, acquire, hold or use funds derived from criminal activities.
The original version of these Terms of Service is written in the English language. Versions in other languages of these Terms of Service and other policies are provided for convenience only. In the event of any inconsistency or discrepancy, the English language version shall prevail.
Important notice:
- If you do not agree to the Terms of Service, you may not use the Applications or the Airtime Service.
- If you are residing in a jurisdiction where it is prohibited by law to offer or use the Airtime Service or our other services, you may not use the services in such jurisdiction.
- When purchasing Airtime through the Airtime Service, you consent to the immediate delivery and use of the product with the designated mobile network operator. Accordingly, you acknowledge and agree that you have no right to withdraw from the purchase or to obtain a refund under these Terms of Service or applicable law.
- You acknowledge and agree that Transfer Galaxy is under no obligation to provide the Airtime Service, and that Transfer Galaxy shall not be liable to you or to any other party for any limitation, suspension, discontinuance, termination or modification of the of the service and/or these Terms of Service.
3. Notices and communication
Any of the Arabic, Dari, English, German, Somali, Swedish, Thai and Turkish languages may be used for communication between you and Transfer Galaxy.
Written communications from Transfer Galaxy to you will be sent by email or SMS to the email address or phone number (as applicable) you have provided and will be deemed to have been received by you on the same day. Alternatively, when appropriate, written communications may appear in your account within the Applications.
Written notices from you to Transfer Galaxy shall be addressed to Transfer Galaxy as set out above in the preamble or sent by email to support@transfergalaxy.com.
Transfer Galaxy may record or otherwise document phone and other oral communication between you and Transfer Galaxy.
4. The Airtime Service
The Airtime Service allows you to purchase prepaid airtime value (for communication and/or data transmission capacity) to be credited to a phone subscription account registered with an end user for certain available network operators and destination countries, as well as certain other types of prepaid closed loop products. The aforesaid products may be referred to as (for instance Mobile Top-up, Balance, Recharge, Airtime, or Bundle). For the purposes of these Terms of Service the terms “Mobile Top-Up" and “Airtime” will be used.
In relation to purchases of Airtime/Mobile Top-ups, our service consists solely of facilitating the purchase and delivery of prepaid airtime value to the eligible mobile phone account. We do not provide the telecommunication service itself, and the use of the airtime value is governed exclusively by the applicable terms and conditions of the relevant mobile network operator. Transfer Galaxy does not guarantee the availability of Airtime/Mobile Top-ups for all operators, price denominations or destination countries, and availability may vary from time to time.
When purchasing prepaid airtime value through the Airtime Service, you designate the recipient and the mobile subscription account to which the airtime value shall be credited. Once delivered to the operator, the airtime value is non-refundable and subject solely to the operator’s applicable terms and policies. The role of Transfer Galaxy is limited to processing your order and facilitating the delivery of the airtime value to the operator.
Please note that Transfer Galaxy may limit the number or value of Airtime/Mobile top-ups you can purchase or receive within certain time periods, as well as apply other restrictions from time to time.
5. Purchases of Airtime/Mobile top-up
Instructions for delivery of Airtime/Mobile top up etc.
You are responsible for ensuring that all instructions provided to us in connection with your purchase of Airtime/Mobile top-ups are complete, correct and true. In particular, the mobile phone number or other identification details of the receiver of the Airtime/Mobile top-up must be correctly identified. All confirmed instructions are final and binding upon you.
Transfer Galaxy shall bear no liability or consequences related to the provision of incorrect, inaccurate or false information by you (without limitation, you will not be entitled to a refund). You are solely responsible for any consequences related to the failure to provide complete, correct and true information or the failure to correct such inaccurate information prior to final confirmation.
Completion of a purchase
Purchases of Airtime/Mobile top-ups must be accepted by the applicable network hub and/or the receiving operator. After accepting the purchase/order such entity/entities become responsible for completing the top-up.
Transfer Galaxy only initiates the top-up to the receiving mobile phone number. The relevant local operators (or other applicable third parties) are responsible for registering the top-up and for delivering the services associated with the credited airtime value. Transfer Galaxy assumes no responsibility for any actions, omissions, delays or errors by such operators or third parties.
If you have provided us with contact details, we will send you a confirmation notice which contains status details, such as when the transaction has been successfully completed. Please note that, occasionally, there may be a short delay before the operator in the destination country/network has credited the recipient’s account.
Payment of a purchase
Upon receiving your confirmed instruction for the purchase of Airtime/Mobile top-up, Transfer Galaxy will place a reservation for the applicable purchase amount and, once the top-up has been successfully completed, charge that amount through your designated payment method.
Once the Airtime/Mobile top-up has been successfully received by the recipient the transaction cannot be revoked, and your payment cannot be refunded.
Incomplete purchases
We will notify you if a purchase of Airtime/Mobile Top-up cannot be completed. A transaction may either (i) fail, in which case the reservation on your credit card or other payment method will be released, or (ii) remain pending, meaning it is still being processed. While pending, the amount will remain reserved but not charged, and no Airtime/Mobile Top-up will reach the recipient.
If you become aware that the Airtime/Mobile Top-up you purchased has not been received, you must notify Transfer Galaxy without undue delay and provide documentation showing the amount paid, the recipient’s details, and any other information needed to verify the transaction.
If a transaction fails due to an error on your side, we may need to charge you for any costs we have incurred as a result (for example, if we have already issued a refund to you). We will only charge such costs when it is fair and reasonable to do so.
6. Fees and charges etc.
Purchases of Airtime/Mobile Top-up are subject to applicable prices, fees and similar). The applicable price list is available on our website and within the Applications.
The products available through the Airtime Service are always provided on a pre-paid basis.
If the Airtime/Mobile Top-up is to be received in a different currency to the currency of your chosen payment method, the payment amount will be subject to the applicable FX exchange rate on the payment date and applicable conversion fees.
Purchases and applicable fees etc. may be paid with the payment methods made available to you in the Applications.
Transfer Galaxy reserves the right to charge service and payment processing fees in relation to purchases of Airtime/Mobile top-up.
In some countries and networks, local taxes and fees may apply. These charges are set by local authorities or operators and are outside the control of Transfer Galaxy. If they apply, they will be deducted from the value of your airtime/mobile top-up.
Unless stated otherwise, all prices, rates and charges are shown excluding value added tax (VAT). If VAT or any other tax or fee applies to a purchase, you are responsible for paying it in addition to the stated price.
7. Payments
All payments are processed via third-party payment processors ("Payment Processor"). You agree to provide complete and accurate payment information and further agree that the processing of payment transactions is subject to the terms, conditions and policies, including privacy policies, of the involved Payment Processor, the issuer of your payment card or any other payment service provider.
You authorize Transfer Galaxy to charge the payment method you have selected whenever an instruction is made through your Account using your password or any other required authentication method. We are not obliged to carry out any additional identity checks beyond what is required by law.
We may refuse to process a payment funded from certain payment instruments or method where we have reason to believe the security of the payment instrument or method has been compromised or where we suspect the unauthorised or fraudulent use.
Any refunds will be credited back to the same payment instrument or method used for the original payment and in the same currency, unless we agree otherwise in the individual case.
Transfer Galaxy will have no responsibility for any fees or charges you may incur using a particular payment instrument or method you have chosen for a purchase (examples include unauthorised overdraft fees imposed by banks if there are insufficient funds in your bank account).
8. Use of the Airtime Services
General principles for use if the service
You agree to use the Airtime Service in accordance with these Terms of Service and applicable legislation and generally accepted practices or guidelines in the relevant jurisdictions (including without limitation any applicable international sanctions, export control regulations or similar legislation).
It is your responsibility to ensure that you are legally allowed to use the Airtime Service in the jurisdiction where you are located. If you are legally restricted or prohibited from using the Airtime Service, you must comply with such restrictions or, if applicable, stop accessing and/or using the services.
The Airtime Service is for your individual use only. You shall not resell or commercialize the service to any third party.
You agree that you are solely responsible (and that Transfer Galaxy has no responsibility to you or any other third party) for any data, content, or resources that you transmit by using the Airtime Service, and for the consequences of such actions (including any loss or damage which Transfer Galaxy or any third party may suffer).
Prohibited use and restrictions
The list below provides examples of prohibited conduct and shall not be considered exhaustive. You agree not to:
- use the Airtime Service for any unlawful purpose, or in any manner inconsistent with the Terms of Service, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into our Applications, technical platform or any other parts of the service;
- use the Airtime Service for money laundering, terrorism financing or any other unlawful purpose;
- conduct such acts so the intellectual property rights of Transfer Galaxy or any third party in relation to the Airtime Service may be infringed;
- transmit any communications that are defamatory, offensive or otherwise objectionable in relation to your use of the Airtime Service;
- directly or indirectly use the Airtime Service for transmitting unsolicited communications (sometimes referred to as "spam"), robocalling, CLI spoofing or any communication not permitted by applicable law or use the Airtime Service for the purposes of phishing, pharming, impersonating or misrepresenting affiliation with another person or entity;
- use the Airtime Service in a way that could damage, disable, overburden, impair or compromise Transfer Galaxy’s or any third party’s systems or security or interfere with other users;
- collect or harvest any information or data from the Airtime Service or our systems or attempt to decipher any transmissions to or from the servers running the service;
- sell, assign, rent, lease, distribute, market, disclose, export, import, act as an intermediary or provider, or otherwise grant rights to third parties with regard to the Airtime Service (or any part thereof);
- use the Airtime Service (or any part thereof) within or to provide commercial products or services to third parties (however not prohibiting you from using the Airtime Service for your own business communications); and/or
- use the Account, our website, our Applications and other part of the Airtime Service in any fraudulent way.
9. Third-parties
You acknowledge that the provision of the Airtime Service depends on services and technical systems of third parties, including the relevant mobile network operators and any other parties involved in the processing or delivery of the prepaid airtime value (each a “Provider”).
The terms and conditions of the recipient’s mobile network operator will govern the use, validity period, tariffs, bundles and any other aspects of the prepaid Airtime/Mobile Top-up. Providers may further apply restrictions, fees, expiry rules or other limitations. You are solely responsible for verifying any such terms, conditions or charges with the relevant mobile network operator or other Provider.
Once a purchase of Airtime/Mobile Top-up has been completed and the prepaid airtime value has been delivered to the designated mobile network operator, Transfer Galaxy has no control over the credited value or plan. Transfer Galaxy is not responsible or liable for the acts, omissions, service quality, coverage, availability or other conditions provided or imposed by any mobile network operator or other Provider in connection with the Airtime Services.
10. Account
To use the Airtime Service you are required to register as a user with Transfer Galaxy. Subject to such registration you will receive access to an individual account (the "Account").
Users must be at least 18 years old to create an account with us and to use the Airtime Service. The Airtime Service is only offered to Users who are located in any of our approved countries (as shown within our Applications from time to time).
You agree to provide true, accurate, up-to-date, and complete information when registering for the Airtime Service and when making any subsequent amendments to the information in your Account, regardless of whether any fields are mandatory. We have the right to change your password/PIN and account name at any time in our sole discretion and without notice.
We recommend that you choose a password/PIN to your Account that is hard to guess and keep it secure. It is your responsibility to ensure that you do not respond to any unsolicited requests for credit card or payment method details, password/PIN or other data. You agree not to disclose your Account credentials and login details safe to any third party.
When you log in to your Account, you may be able to view information about your use of the Airtime Service, such as recent activity, purchases and payments. You may also receive receipts by email. These account records are the only statements Transfer Galaxy will provide. It is your responsibility to save or print them for your own records.
Transfer Galaxy will make commercially reasonable efforts to fix any technical issues affecting your account records or your ability to view such records. However, if you are temporarily unable to view them, you are still responsible for the activities on your Account, including for paying any amounts you owe.
Transfer Galaxy is not responsible for storing or backing up your data, content, or account history. We recommend that you back up any information you wish to keep.
11. User responsibility
General
You are responsible for (i) complying with these Terms of Service (as applicable from time to time) as well as any applicable law and regulations and specific instructions provided within the Airtime Service; and (ii) ensuring that the information provided to us at all times are valid, complete and correct.
Unauthorised access
You are responsible for ensuring that private information, such as login credentials, passwords and the like, is used and dealt with safely and that it is kept secret and inaccessible to unauthorised persons.
You are required to inform our customer support team by email or phone as soon as possible if there is any reason to believe that an unauthorised person has gained access to or knowledge of login information, passwords and/or equivalent information. You further undertake to immediately review and examine information about completed purchases using the Airtime Service, which is provided to you by email following a completed purchase and/or made available to you within the Applications.
If you fail to comply with the security instructions described above, you will be responsible for any damage caused to us and for any debiting arising from the use of the Airtime Service by an unauthorised person. Unauthorised debiting must be notified directly to the relevant bank to block the applicable card / bank account and to reclaim the relevant payment.
If we would become aware of any unauthorised access or other security risks in relation to your account, we will contact you by phone or email or notify you within our Applications.
You are responsible for all activities carried out using your login credentials. We are not liable for unauthorised access resulting from your failure to keep your credentials secure.
12. Availability
The Airtime Service is normally available twentyfour (24) hours a day, but availability may be limited in connection with any malfunctioning or failure of our or any intermediary parties’ systems or when either of us carry our technical maintenance, updates or service to any of our systems.
Transfer Galaxy cannot be held liable in case a purchase or other action cannot be made due to such limitations.
13. Limitation of liability
General
We are not responsible for any damage due to failures in power supply, telecommunications or Internet connections, or other technical equipment not belonging to us.
We are neither responsible for any indirect damage.
Our total aggregate liability for all damages and losses arising from your use of the Airtime Service, or otherwise covered by these Terms of Service, shall not in any circumstance exceed the amount paid by you for the service or for purchases using the service during the preceeding twelve (12) months prior to the event giving rise to the relevant claim or a maximum of five thousand (5 000) euro. This limitation does not apply to any liability that cannot be limited under applicable law or for intentional misconduct.
Force majeure
We are not responsible for any damage caused by law-enforcement actions, government action, war-related events, pandemics, strikes, lockouts, boycotts and blockades or other unusual or unpredictable circumstance in Sweden or abroad over which we have no influence and whose consequences we could not have prevented. The reservation regarding strikes, lockouts, boycotts and blockades applies even if we ourselves are subject to such conflict measures.
We are neither responsible for any damage caused if we have acted in accordance with Swedish or EU law.
If there is a hindrance to us in taking any other action due to circumstances under this paragraph, the action may be suspended until the hindrance has ended.
No warranties
You acknowledge that you use the Airtime Service at your own risk. To the maximum extent permitted by law, the Airtime Service is provided “as is” and “as available,” without any warranties of any kind, whether express, implied, or statutory. This includes, without limitation, any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted or error-free service.
We do not guarantee that the Airtime Service will always be available, secure, or free from defects, or that any issues will be corrected. No information or advice we provide creates a warranty. You are responsible for any costs arising from issues caused by your use of the Airtime Service.
You understand that communications may be intercepted by law enforcement or third parties, and that telecommunications and other networks may experience downtime.
Nothing in these Terms of Service affects your rights under mandatory provisions of applicable law.
14. Term
These Terms and your agreement with us in respect of the Service are valid until further notice.
15. Additions and changes
We may add and/or change these Terms of Service by giving you at least one (1) months’ prior written notice. If we do this, you can terminate your agreement with us immediately by providing written notice to our customer support team during the notice period. If we do not hear from you during the notice period, you will be considered as having accepted the proposed changes, and they will apply to you from the effective date specified on the notice.
We may change our prices, fees and exchange rates with immediate effect and without prior notice to you. Prices, fees and exchange rates will be presented to you before you accept a purchase using the Airtime Service.
In addition, we may with immediate effect and without prior notice make such changes to these Terms of Service that (i) are required by law, regulation or decision by applicable authorities (unless the change is less favourable to you in which case we will send you a written notice or notify you within our Applications); and/or (ii) neither reduce your rights nor increase your responsibilities.
We may also change and update our website and our Applications, as well as our products and services at any given time and without prior notice. Updated information can be obtained at our website or within our Applications. You are always welcome to contact our customer support team if you have any questions regarding changes and/or updates.
16. Termination
You may end your agreement with us and close your Account at any time by providing a termination notice in writing to our customer support team.
We may end our agreement with you and close your Account or any service associated with it by giving you two (2) months’ prior written notice.
In addition, we may at any time suspend or restrict your Account and/or end our agreement without notice if we have reason to believe (as determined in our discretion) that: (i) intentionally or unintentionally, you are in breach of any provision of these Terms of Service or any other policies or instructions related to the Airtime Service and, following our request, do not take immediate correction; (ii) the use of the Airtime Service is non-secure; (iii) we are requested, directed or recommended to do so by any competent court of law, regulatory authority, public agency, law enforcement agency and/or industry association; and/or (iv) the Airtime Service is being used in a way that materially deviates from normal and reasonable usage patterns, based on expected use cases and our available usage data.
We may also suspend or restrict your Account and/or end our agreement without notice, if you have i) not used the Airtime Services for a period of two (2) years; and/or ii) through any means of communication intimidated, harassed and/or threatened Transfer Galaxy or its employees.
Provided that we are not prohibited by law from doing so, we will as soon as practically possible give you notice of any suspension or restriction of your Account and/or the termination of our agreement including the reasons, therefore. We will lift the suspension or restriction when the reasons for such suspension or restriction have ceased to exist.
In the event of such suspension, we may reinstate access to your Account and recommence providing the Airtime Service to you at our sole discretion.
17. Right of withdrawal
By law, you have a right of withdrawal and may terminate your agreement with us within fourteen (14 ) days from the day our agreement was concluded.
Please note that the right of withdrawal applies only to your agreement to use the Airtime Service, and not to any Airtime/Mobile Top-Up purchases made through the service. By consenting to immediate delivery, you acknowledge that each Mobile Top-Up is delivered and available for use with the designated mobile network operator right away. The purchase of the Mobile Top-up is therefore exempt from the right of withdrawal.
You may exercise your right of withdrawal by giving us notice in writing to our customer support team.
18. Intellectual property
All information and/or intellectual property rights disclosed by us within the Airtime Service or otherwise are owned by us, our affiliates or partners. The access to or disclosure by us does not give you any license or other rights whatsoever in respect of any part of such information or intellectual property right, unless specifically stated herein.
You agree to only use the Airtime Service for your own personal use and only as permitted by these Terms of Service and in accordance with any information provided within the service. The Airtime Service may not be used for the purpose of testing the service for commercial use or to obtain information about the service or about us.
You may not modify, reverse engineer, disassemble, or decompile the Airtime Service or any software contained therein or duplicate, publish, create derivative works from, or otherwise distribute or exploit the Airtime Service or any part thereof without our express written permission.
19. Refunds
If you believe you have been charged in error, you may request for a refund by contacting our customer support at support@transfergalaxy.com.
Refunds are not available for services paid with vouchers, gift tokens, or similar methods.
Transfer Galaxy may deny repeated refund requests. Misuse of the refund process may result in suspension or termination of your services.
Refund requests must be submitted within ninety (90) days of your payment. After this period, all charges are final and non-refundable.
20. Feedback
You may provide comments, suggestions, ideas or other input regarding the Airtime Service (“Feedback”). You agree not to include any confidential or proprietary information in your Feedback.
By submitting Feedback, you grant Transfer Galaxy a worldwide, perpetual, irrevocable, royalty-free and fully transferable license (with the right to sub-license) to use, modify and otherwise exploit the Feedback for any purpose.
You are responsible for ensuring that your Feedback is lawful, accurate and does not infringe any third-party rights.
15. Assignment
We are entitled to transfer to a third party all or part of our rights and obligations under these Terms of Service. We are also entitled to engage sub-suppliers to fulfil any of our obligations. You may not assign any of your rights and obligations under these Terms of Service to a third party.
22. No waiver
The failure by Transfer Galaxy to exercise, or to delay in exercising, a legal right or remedy provided by these Terms of Service or by law shall not constitute a waiver of its right or remedy.
If Transfer Galaxy waives a breach of these Terms of Service, the waiver shall not operate as a waiver of any subsequent breach. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
23. Processing of personal data
We process personal data of our users as a data controller in order to e.g. fulfil our agreements and provide our services as well as to comply with our legal obligations.

24. Governing law
These Terms of Service and the agreement between you and Transfer Galaxy shall be governed by Swedish law (unless other mandatory law in favour of the User applies).
Transfer Galaxy is, notwithstanding the above, entitled to seek injunctive or equivalent relief before any court of competent jurisdiction.
